NestWorks Terms of Service

1. Platform Description

NestWorks is a parent-directed education platform and marketplace that enables parents, legal guardians, students, and independent tutors to access educational resources, tools, and services. NestWorks does not operate as a school, school district, or educational institution, and does not provide diplomas, grades, or credits.

2. Eligibility

By using NestWorks, you represent and warrant that you are:

• A parent, legal guardian, student (with parental permission), or authorized tutor/instructor;
• At least 18 years old (or have legal authority to consent);
• Legally permitted to use our Services in your jurisdiction.

3. Parent Responsibility

Parents and legal guardians retain full responsibility for their child’s education. NestWorks provides tools and resources to support parent-directed education, including homeschooling and supplemental learning programs.

Parents/guardians are solely responsible for:

• Determining their child’s educational program.
• Ensuring compliance with all applicable state and local education laws.
• Maintaining any required records, assessments, or filings.
• Ensuring proper supervision of students.

4. State Law and Compliance Disclaimer

Education laws, homeschooling rules, and compliance requirements vary by state and locality and are subject to change.

Any state-specific information, tools, templates, or guidance provided by NestWorks isfor informational purposes only and does not constitute legal advice. Users are encouraged to review official state and local guidance and consult legal counsel where appropriate.

5. School Withdrawal

NestWorks may provide templates or guidance to assist parents in withdrawing students from public or private schools.

• Submission, acceptance, and processing of withdrawal documents is determined solely by the relevant school district or education authority.
• NestWorks does not act on behalf of schools and cannot guarantee acceptance.

6. Independent Tutor and Instructor Services

Tutors, teachers, instructors, and other service providers listed on NestWorks areindependent third-party contractors, not employees, agents, or representatives of NestWorks.

• Does not supervise or control tutors;
• Does not guarantee the quality, credentials, or outcomes of any tutor;
• Provides only a platform for connecting users to service providers.

7. No Guarantee of Educational Outcomes

NestWorks does not guarantee academic progress, grade advancement, test scores, or admission to any school or program. Educational outcomes depend on parental involvement, student engagement, and the services selected.

8. Records and Data

Any records, portfolios, attendance logs, or learning documentation generated via NestWorks:

• Are user-managed.
• Do not constitute official school records, transcripts, or diplomas.
• May be exported or deleted at the user’s discretion.

NestWorks is not a school and is not subject to FERPA, but implements reasonable safeguards to protect user data.

9. Payments, Scholarships, and ESA Programs

Payments for tutors, curricula, or other services are processed through NestWorks, which may charge a platform fee.

Acceptance and use of Educational Savings Accounts (ESAs), scholarships, or third-party educational funds is subject to the rules of the administering organization. NestWorks isnot responsible for approval, reimbursement, or eligibility decisions made by third parties.

10. User Conduct

By using NestWorks, you agree not to:

• Impersonate any person or entity;
• Use the platform for unlawful purposes;
• Violate any applicable education laws;
• Misrepresent qualifications or credentials;
• Infringe intellectual property or privacy rights.

NestWorks reserves the right to suspend or terminate accounts for violations.

11. Intellectual Property

All content, trademarks, logos, software, and materials provided by NestWorks are the property of NestWorks or its licensors.

Users may not copy, reproduce, distribute, or create derivative works without prior written permission.

12. Disclaimer of Warranties

• Services will meet user expectations;
• Access will be uninterrupted or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, NestWorks and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to:

• Educational outcomes;
• Compliance with laws;
• Tutor or service provider performance;
• Loss of data or records.

14. Indemnification

You agree to indemnify, defend, and hold harmless NestWorks, its officers, employees, and affiliates from any claims, losses, liabilities, or expenses arising from:

• Your use of the platform;
• Your educational decisions or actions;
• Engagement with tutors or third-party services;
• Violation of these Terms.

15. Modifications to Terms

NestWorks may update these Terms at any time. Changes will be posted on the website, and your continued use constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the state of incorporation of NestWorks, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of that jurisdiction.
